International Air Safety Law, 1988 World Congress

On 8 March 1988, after many months of hard work, the Organising Committee publicly launched the ALAA’s International Air Safety Law 1988 World Conference. Patron of the Congress, the Honourable Sir Laurence Street, KCMG, Chief Justice of New South Wales, welcomed sponsors and the large number of contributors to the cocktail party launch and in congratulating the Organising Committee pointed to the ever-growing need for specialist aviation law expertise and the significant role the Congress will play in the development of that knowledge.

The Congress will be conducted in Sydney from 12 to 15 October 1988 and already looks like attracting approximately 400 attendees from Australia and countries around the world. ” As its title suggests, the theme of the Congress is air safety in its application to both domestic and international operations and will study in detail the effects of deregulation in the US and the EEC. With deregulation looming in Australia, it is envisaged that the Congress will provide the most professional and informed forum ever likely to be assembled on the topic in this country.

The Congress will be officially opened by the Honourable Senator Gareth Evans, the Minister for Transport and Communication in the Australian Government. An impressive array of speakers has been engaged and they will bring with them many years of experience in Australian and overseas air transport.

International speakers include Mr Justice Cecil Margo QC, a Fellow of the Royal Aeronautical Society and a licensed pilot who Includes in his 40 years of association with the industry his role as the architect of the Israeli Air Force. His Honour is internationally regarded as without peer as an advocate, and more recently as a judge, in air accident investigation.

Jim Marquez, formerly the US Department of Transportation’s General Counsel, and Ron Margo, author of the standard text on aviation insurance, both of the US firm Condon and Forsyth, will review the American deregulation experience with Peter Suther- land, the EEC’s Competition Commissioner, detailing de- regulation in Europe.

Londoners Ernie Crouch of Lloyds Underwriting and Harvey Crush, an eminent London solicitor, will further ensure a comprehensive examination of overseas air safety.

Australian speakers include Sydney solicitors John Mant, Peter Harbison and Henry Herron together with the Commercial Director of Hawker de Havilland, Peter Smith, who is one of Hawker’s key aerospace executives. Captain Trevor Jensen, Qantas’ Flight Safety Captain will also provide a rare and valu- able Opportunity for insight into our flag carrier’s approach to air safety.

A substantial list of sponsors have, through their support, guaranteed the Congress’ success; they Include some of the principal overseas airlines with Qantas and Hawker de Havilland/ Hawker Pacific heading the list of domestic supporters.

By no means least of the sponsors is Tyrell’s Vinyards who have promised to provide a varied and plentiful selection of their fine wines-Queensland branch ALAA members please note! 120 Australian Aviation July 1988 The venue for the Congress is the luxurious Sydney Hilton International Hotel, centrally located in Australia’s first and most exciting city and a mere 25 minutes from Sydney Kingsford Smith Airport. A comprehensive programme of social activities has also been established, including a welcoming cocktail party. Sumptuous daily luncheons and a gala closing dinner at Sydney’s spectacular Opera House.

In short, the Congress has been planned to satisfy not only the cerebral appetite but the less otiose needs as well. It is sincerely hoped that all ALAA members and their spouses and associates will take the opportunity to reunite with fellow members and to welcome Our overseas speakers and colleagues.

Substantial accommodation has been reserved well in adv- ance at the Hilton International and at a number of Sydney’s other premier hotels. As part of the Congress package. attendees will also visit the Australian Bicentennial Air Show and will enjoy privileged Industry Status during their visit. Legal practitioners in New South Wales should note that the ALAA has applied to the Law Society for a 10 Point MCLE accreditation.

The cost of Congress registration has been set at $400 per Delegate and $150 per Accompanying Person. Payment of the registration fee prior to 30 June 1988 results not only in a current year taxation advantage (where applicable) but will also provide the early delegate with a $50 discount.

Registration Forms and further information on the Congress can be obtained from the conference organiser Mr Ron Cook of Travelaw, 130 Phillip Street, Sydney (Fax: (02) 231 2758).

Without a doubt the Congress comes at a time when Australia is about to embark on probably the most significant and potenti- ally difficult phase of postwar aviation development.

It is also clear that the challenges facing the industry will be more easily met if the industry, and those who advise it, can bring to bear, as well as their own expertise, the benefit of the experiences of those who have already endured similar revolutions overseas.

The International Air Safety Law Congress will prove to be one of the most significant international conferences of its type in the world and the opportunity to participate in it should not be lost.

Aviation Regulatory Review

In the May/June edition of the magazine the formation of an ALAA committee to formulate submissions for the Regulatory Review was announced.

In response to invitations by the ALAA, several members have provided material for inclusion in our submission. The ALAA Committee has singled out the following matters for special attention: ANR191; Summary suspension of licences especially pilots’ licences; and the scope, generally, of the discretions vested in Departmental delegates.

Those and interrelated issues appear to the ALAA Committee to be matters of high concern to many in the industry and they deal with sensitive legal questions that have for many years been seriously neglected.
